Terms of Service

By accessing or using Apoliums services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all users of the platform, including visitors, registered users, and paying customers. We reserve the right to update these terms at any time with reasonable notice.

Apoliums provides AI-powered business automation services including: • Automated call handling and appointment booking • Lead management and follow-up campaigns • HR hiring automation workflows • CRM and email integration services • AI-generated content and notes • Weather monitoring and alert systems Services are provided on a subscription basis and subject to the plan you have selected.

To use our services, you must: • Provide accurate, current, and complete registration information • Maintain the security of your account credentials • Promptly update your account information if it changes • Accept responsibility for all activity under your account • Be at least 18 years of age or have the authority to enter into contracts You are responsible for maintaining the confidentiality of your password. Notify us immediately at security@apoliums.com if you suspect unauthorized access.

You agree NOT to use Apoliums to: • Send spam, phishing emails, or unsolicited communications • Violate any applicable laws or regulations • Infringe on intellectual property rights • Distribute malware or engage in harmful activities • Scrape or extract data beyond what is permitted by the API • Resell or sublicense our services without written permission • Impersonate other persons or entities Violation of these terms may result in immediate account suspension or termination.

• Subscriptions are billed monthly or annually in advance • All fees are non-refundable except as stated in our refund policy • We offer a 30-day money-back guarantee on first-time subscriptions • Failed payments may result in service suspension after 7 days notice • Prices may change with 30 days advance notice to existing customers • All prices are in INR unless otherwise specified • Taxes (GST) will be added where applicable

Apoliums and its licensors retain all intellectual property rights to: • The Apoliums platform, software, and technology • Our brand, logo, and visual identity • Documentation, tutorials, and marketing materials You retain all rights to your own data, workflows, and content. By using our platform, you grant us a limited license to process your data solely to provide the services. You may not copy, modify, distribute, or reverse engineer any part of our platform without written permission.

Your use of Apoliums is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You represent that you have the right to collect and process the data you use in our platform, and that such use complies with all applicable data protection laws including the Information Technology Act, 2000 and PDPB guidelines.

TO THE MAXIMUM EXTENT PERMITTED BY LAW: • Apoliums is provided "as is" without warranties of any kind • We are not liable for indirect, incidental, or consequential damages • Our total liability shall not exceed the amount you paid us in the 3 months preceding the claim • We do not guarantee uninterrupted or error-free service • We are not responsible for third-party service failures (carriers, APIs, etc.) Some jurisdictions do not allow limitations on implied warranties, so these limitations may not apply to you.

Either party may terminate the agreement: • You: Cancel anytime from your account dashboard. Access continues until end of billing period. • Us: We may suspend or terminate accounts that violate these Terms, with or without notice. Upon termination: • Your access to the platform will end • We will delete your data per our Data Retention Policy (30 days) • Outstanding fees remain due and payable

These Terms are governed by the laws of India. Any disputes shall be resolved through: 1. Good faith negotiation (30-day period) 2. Mediation in Bangalore, Karnataka 3. Arbitration under the Arbitration and Conciliation Act, 1996 The courts of Bangalore, Karnataka shall have exclusive jurisdiction for any matters not resolved through arbitration.
